Ozekhome Laments Miscarriage of Justice in Court of Appeal

Constitutional Lawyer Professor Mike Ozekhome, SAN, has lamented that the Supreme Court’s recent decisions on governorship elections in eight states have exposed the miscarriage of justice by the Court of Appeal, particularly in Plateau State.

The Senior Advocate of Nigeria who called on the National Judicial Council (NJC) to investigate the Justices of the Court of Appeal who decided these cases following the Friday Supreme Court Judgement believes that all electoral matters should end at the Supreme Court due to their crass and deliberate miscarriage of justice in Plateau election cases.

He described Friday’s judgment as judicial ‘Koboko’ on the Court of Appeal during his appearance on Arise Television programme on Saturday. The apex court castigated some rulings made by its counterpart while overturning their verdicts regarding Kano, Plateau and Zamfara.

The Constitution Lawyer held views opposing many cases such as those involving State Houses and National Assemblies reaching up to Supreme Courts, Ozekhome now thinks that a miscarriage of justice like what happened with sacking Plateau lawmakers needs examination by them.

In November 2023, elected members belonging to Peoples Democratic Party (PDP) in Plateau State Assembly were sacked after being ruled out since 2020 because PDP structure collapsed; hence they couldn’t sponsor any candidate for an election. According to Ozekhome: “The judgement was a clear case where there had been a miscarriage of justice.”
